NDISDA® SDA HOUSING & DISABILITY

EVENT TERMS AND CONDITIONS as at 1 July 2024

These Event Terms and Conditions apply to events organised or convened by NDISDA® SDA Housing & Disability, including conferences, summits, forums, roundtables, workshops, professional development sessions, seminars, networking events, webinars, livestreams and other events promoted by NDISDA® SDA Housing & Disability and its Event Partners.

By purchasing or registering for a ticket to an Event, the purchaser and registered Delegate acknowledge and agree to these Event Terms and Conditions.

​

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy available under the Australian Consumer Law or other applicable legislation where it would be unlawful to do so.

1. DEFINITIONS

For the purposes of these Terms and Conditions:

“Event” means any conference, summit, forum, roundtable, workshop, professional development session, seminar, networking event, webinar, livestream or other event organised or convened by NDISDA® SDA Housing & Disability.

“Event Organiser” means NDISDA® SDA Housing & Disability, ABN 84 123 926 956.

“Event Partner” or “Partner” means an organisation, professional network, program, sponsor, supporting organisation or other party participating with or supporting NDISDA® SDA Housing & Disability in connection with an Event.

“Delegate” or “Attendee” means the person registered to attend an Event.

“Ticket” or “Registration” means a confirmed registration to attend an Event.

References to “NDISDA®” in these Terms and Conditions mean NDISDA® SDA Housing & Disability where the context permits.

2. REGISTRATION AND PAYMENT

  • Each registration is valid for one Delegate only and must not be shared between multiple people.

  • Full registration details and payment must be received no later than 24 hours before the Event unless otherwise agreed by NDISDA®.

  • NDISDA® reserves the right to refuse admission where applicable registration fees have not been paid in full.

  • Delegates are responsible for having their Event registration or ticket available electronically or in printed form where requested for admission.

  • Where an Event, session or ticket category is restricted to a particular professional group, organisation type or sector, including hospital, healthcare, government, disability, aged care or other invited personnel, NDISDA® may request reasonable evidence that the Delegate meets the applicable eligibility requirements.

  • ​Where a Delegate has registered under an incorrect or ineligible ticket category, NDISDA® may require the Delegate to pay the applicable registration fee before admission.

3. CANCELLATIONS AND NO-REFUND POLICY

All registrations are final and non-refundable for attendee-initiated cancellations, except where a refund or other remedy is required by the Australian Consumer Law or other applicable law.

Once a registration has been confirmed, NDISDA® commits to costs based on confirmed Delegate numbers.

These costs may include venue hire, catering, staffing, administration, suppliers, equipment, technology and other Event delivery costs which may remain payable regardless of whether a registered Delegate ultimately attends.

Accordingly, a refund will not be provided where a Delegate chooses not to attend or becomes unable to attend, including due to:

  • Change of mind;

  • Illness or personal circumstances;

  • Changes to business or work commitments;

  • Inability to obtain employer or management approval;

  • Scheduling conflicts;

  • Changes to travel plans;

  • Flight delays or cancellations;

  • Inability to travel;

  • Failure to make appropriate travel or accommodation arrangements; or

  • Any other attendee-initiated cancellation or inability to attend.

Failure to attend an Event does not entitle a Delegate or ticket purchaser to a refund.

Delegates are encouraged to make use of the ticket-transfer provisions below where they are unable to attend.

Nothing in this section excludes, restricts or modifies any statutory right or remedy that cannot lawfully be excluded.

4. TICKET TRANSFERS AND DELEGATE SUBSTITUTIONS

Where a registered Delegate is unable to attend, the registration may ordinarily be transferred to another eligible person at no additional charge.

NDISDA® must receive the replacement Delegate's:

  • Full name;

  • Email address;

  • Company or organisation;

  • Position or professional role; and

  • Accessibility or dietary requirements, if applicable,

at least 24 hours before the Event.

Where a ticket or Event is restricted to a particular professional group, organisation type or sector, the substitute Delegate must satisfy the same eligibility requirements as the original Delegate unless otherwise approved by NDISDA®.

Delegate substitutions cannot ordinarily be processed on the day of the Event.

Dietary requirements should be provided at least seven days before the Event. NDISDA® cannot guarantee that new or amended dietary requirements can be accommodated where a substitution is made within seven days of the Event.

Registrations cannot be shared between Delegates.

5. PROGRAM CHANGES

The advertised Event program is provided as a guide and is subject to change.

NDISDA® and its Event Partners will make every reasonable effort to deliver the Event substantially as advertised, including scheduled speakers, presenters, facilitators, session times and topics.

However, NDISDA® reserves the right to make reasonable changes where necessary, including:

Substituting, adding or withdrawing speakers, presenters, facilitators or panellists;

  • Changing presentation topics or session content;

  • Changing session times or the order of presentations;

  • Combining, replacing, rescheduling or removing individual sessions;

  • Changing the Event format or method of delivery; or

  • Making other reasonable changes due to unforeseen circumstances or matters beyond our reasonable control.

Where practicable, NDISDA® will endeavour to communicate significant changes to registered Delegates using the email address supplied at registration.

Where a significant change is known sufficiently in advance, NDISDA® will aim to provide at least seven days' notice. However, changes may occur at short notice or on the day of the Event and advance notification cannot be guaranteed.

6. SPEAKERS, PRESENTERS AND PANELLISTS

All advertised speakers, presenters, facilitators and panellists are subject to availability.

If a scheduled speaker, presenter, facilitator or panellist becomes unavailable or is unable to participate, NDISDA® will make reasonable efforts to secure a suitable replacement with relevant experience or expertise or provide an appropriate alternative session.

Where a replacement cannot reasonably be arranged, the relevant session may be amended, rescheduled, replaced or removed from the program.

A speaker substitution, withdrawal or other minor program change does not, by itself, constitute cancellation of the Event and does not automatically entitle a Delegate to a refund.

Where a change is sufficiently significant to give rise to a statutory right or remedy under the Australian Consumer Law or other applicable legislation, those rights will apply.

7. POSTPONEMENT, RESCHEDULING OR RELOCATION

NDISDA® reserves the right to postpone, reschedule, relocate or change the delivery format of an Event where reasonably necessary due to circumstances beyond its reasonable control.

These circumstances may include, but are not limited to:

  • Government restrictions or directions;

  • A declared State of Emergency;

  • Natural disasters;

  • Severe weather;

  • Public health or safety concerns;

  • Venue unavailability;

  • Industrial action;

  • Significant transport disruption;

  • Failure of essential services; or

Other circumstances that make proceeding as originally scheduled unsafe, unlawful, impracticable or unreasonable.

Where an Event is postponed, rescheduled or relocated, NISDA® will endeavour to notify registered Delegates as soon as reasonably practicable.

Any entitlement to a refund, credit, transfer or other remedy in these circumstances will be determined in accordance with the Australian Consumer Law and other applicable legislation.

8. EVENT CANCELLATION

If NDISDA® cancels an Event and does not reschedule the Event or provide a reasonable alternative, registered Delegates will receive any refund or other remedy to which they are entitled under applicable law.

Where a refund is payable, NDISDA® will advise registered Delegates of the applicable refund process.

​

9. TRAVEL, FLIGHTS AND ACCOMMODATION

Delegates are responsible for arranging and paying for their own travel and accommodation associated with attending an Event.

This includes, without limitation:

  • Airfares and flights;

  • Hotels and other accommodation;

  • Taxis and rideshare services;

  • Transfers and ground transportation;

  • Car hire;

  • Parking;

  • Travel booking fees;

  • Travel amendment or cancellation fees; and

  • Other associated travel expenses.

NDISDA® strongly recommends that Delegates make flexible or refundable travel and accommodation arrangements and consider appropriate travel insurance.

To the maximum extent permitted by law, NDISDA® and its Event Partners are not responsible for travel, accommodation or associated costs or losses incurred as a result of:

  • A Delegate cancelling or being unable to attend;

  • A speaker substitution or withdrawal;

  • A program or scheduling change;

  • Postponement or rescheduling;

  • Relocation or change in Event format; or

  • Cancellation of the Event.

Nothing in this section excludes or limits any entitlement to compensation or reimbursement that a Delegate may have under the Australian Consumer Law or other applicable legislation and which cannot lawfully be excluded.

10. TRAVEL AND EVENT INSURANCE

Delegates are responsible for determining whether they require travel, cancellation, personal accident or other insurance in connection with attending an Event.

NDISDA® recommends that Delegates travelling to an Event consider appropriate insurance and flexible or refundable travel and accommodation arrangements.

Except where liability cannot lawfully be excluded, NDISDA® and its Event Partners are not responsible for costs incurred because a Delegate has failed to obtain appropriate insurance or refundable travel arrangements.

11. PURPOSE OF NDISDA® EVENTS

NDISDA® Events are designed to support professional information sharing, education, discussion and engagement across disability, housing, health, hospital, aged care, community and related sectors.

Depending on the Event, participants may include representatives from:

  • NDIS and disability service providers;

  • Specialist Disability Accommodation providers and stakeholders;

  • Supported Independent Living providers;

  • Support Coordination;

  • Allied health;

  • Hospitals and health services;

  • Hospital discharge, patient flow and transition personnel;

  • Aged care and in-home support;

  • Housing and community services;

  • Government departments and agencies;

  • Statutory authorities;

  • Injury insurance and lifetime care schemes;

  • Universities and research organisations;

  • Professional and industry organisations; and

  • Other relevant organisations and professionals.

Participation in an NDISDA® Event does not create an employment, agency, partnership, referral, procurement or service-provider relationship between NDISDA®, an Event Partner, Delegate, speaker or participating organisation.

Attendance or participation by a hospital, government agency, statutory authority or other organisation does not constitute that organisation's endorsement, approval or recommendation of NDISDA®, an Event Partner, Delegate, provider, product or service.

12. PROFESSIONAL ENGAGEMENT AND NON-SOLICITATION

NDISDA® Events are intended to provide a professional environment in which participants can exchange information, better understand sector roles and responsibilities, discuss challenges and pathways and develop appropriate professional connections.

  • Delegates must respect the professional responsibilities, privacy obligations, procurement requirements, internal policies and decision-making processes of hospitals, health services, government departments, statutory authorities and other participating organisations.

  • Delegates must not engage in unreasonable, persistent or inappropriate solicitation, sales pressure or unsolicited marketing towards hospital, health, government, statutory or other invited representatives participating in an Event.

  • The exchange of business details and professional networking is permitted where it is mutual, appropriate and respectful.

  • Where a Delegate wishes to pursue an opportunity or professional connection arising from an Event, this should occur through appropriate professional channels and with the consent of the relevant party.

  • Delegates must not represent or imply that participation in an NDISDA® Event provides preferred-provider status, referral status, government approval, hospital approval, endorsement or guaranteed access to referrals, participants, patients, clients, contracts or procurement opportunities.

  • NDISDA® reserves the right to intervene where conduct is inconsistent with the professional purpose of an Event and, where reasonably necessary, may refuse admission to or remove a Delegate whose conduct is inappropriate, disruptive or materially detrimental to other participants.

13. PRIVACY, CONFIDENTIALITY AND CASE DISCUSSIONS

Delegates must respect the privacy and confidentiality of individuals, patients, NDIS participants, aged care recipients, clients, families and other persons who may be referred to or discussed during an Event.

Delegates should not disclose personally identifiable, confidential, sensitive or protected information about an individual unless they are lawfully authorised to do so and the disclosure is appropriate in the circumstances.

Where individual cases, scenarios or practical examples are discussed, participants should wherever practicable use de-identified information.

Participation in an Event does not alter or replace any privacy, confidentiality, professional, employment, contractual or statutory obligation applying to a Delegate or their organisation.

Delegates remain responsible for complying with the privacy, confidentiality, consent, information-sharing and record-management requirements applicable to their own role and organisation.

NDISDA® does not request or require Delegates to disclose confidential patient, participant or client information during Event discussions.

14. SPEAKER AND PARTICIPANT VIEWS

Statements, opinions, analysis and conclusions expressed by speakers, presenters, facilitators, panellists, Delegates and other Event participants are their own unless expressly stated otherwise.

They do not necessarily represent the views of NDISDA®, its directors, employees, agents, advisers, affiliates or Event Partners.

The inclusion of a speaker, presenter, organisation or Event Partner does not constitute endorsement by NDISDA® of that person's or organisation's opinions, statements, products or services.

Similarly, participation in an NDISDA® Event does not constitute endorsement by NDISDA® of any particular provider, service, organisation, housing solution, funding approach, product or commercial arrangement.

15. EVENT CONTENT AND PROFESSIONAL ADVICE

Presentations, discussions, papers, handouts, recordings and other Event materials are provided for general information, professional education and discussion purposes.

Unless expressly stated otherwise, Event content does not constitute individual:

Legal advice;

  • Clinical or medical advice;

  • Financial, taxation or investment advice;

  • NDIS planning or funding advice;

  • Discharge-planning advice;

  • Case-management advice;

  • Housing or accommodation advice; or

  • Other professional advice specific to an individual or organisation.

NDISDA® Events may discuss legislation, regulation, NDIS requirements, funding pathways, government programs, hospital processes, housing options, service models, aged care pathways and professional practices.

Such information may change and may depend upon individual circumstances, jurisdiction, funding decisions, organisational policies, clinical considerations and applicable legislation.

Delegates and organisations remain responsible for their own professional, clinical, operational, legal, regulatory and business decisions and should obtain appropriate independent professional advice where required.

NDISDA® does not warrant that information supplied by independent speakers, presenters, Event Partners or contributors is complete, current, accurate or appropriate for a particular person, participant, patient, client, organisation or circumstance.

16. NDIS, HEALTH, HOSPITAL AND GOVERNMENT INFORMATION

NDISDA® SDA Housing & Disability is an independent professional network and information and education platform.

Unless expressly stated otherwise, NDISDA® is not the National Disability Insurance Agency, NDIS Quality and Safeguards Commission, Department of Health, Disability and Ageing, a State or Territory health department, hospital, health service, government department, statutory authority or regulator.

​

Participation by representatives of any government department, hospital, health service, regulator, statutory authority or agency does not mean that the Event, NDISDA®, its Event Partners or participating organisations or providers are endorsed, approved or recommended by that organisation.

​

Information concerning the NDIS, SDA, SIL, hospital discharge and transition pathways, aged care, health services, government programs, injury insurance schemes, funding arrangements or regulatory requirements should be considered in conjunction with current official information and, where appropriate, independent professional advice.

​

Individual eligibility, funding, approval, service, accommodation, clinical and discharge decisions remain matters for the relevant individual, organisation, professional, agency, authority or decision-maker.

​

Attendance at or participation in an NDISDA® Event does not guarantee NDIS funding, housing approval, referrals, hospital discharge outcomes, service agreements, procurement opportunities or other commercial or professional outcomes.

​

17. DELEGATE CONDUCT

Delegates are expected to conduct themselves professionally, respectfully and safely while participating in an Event.

NDISDA® is not responsible for statements, communications or conduct of individual Delegates or other participants.

Delegates must not engage in conduct that is unsafe, threatening, abusive, discriminatory, harassing, disruptive or unlawful.

Delegates are also expected to respect professional boundaries and the differing responsibilities of health, disability, aged care, housing, government and community-sector participants.

NDISDA® reserves the right to refuse admission to, or remove from an Event, any person whose conduct is reasonably considered unsafe, disruptive, abusive, discriminatory, unlawful, inconsistent with these Terms and Conditions or materially detrimental to the Event or its participants.

Where a Delegate is removed for such conduct, no refund will be provided except where required by law.

18. ADMISSION, EVENT ELIGIBILITY AND CONFLICTS OF INTEREST

NDISDA® reserves the right, where reasonably necessary, to refuse or limit registration or attendance where:

  • An Event or session has specific professional or sector eligibility requirements;

  • Attendance is restricted to invited organisations or representatives;

  • There is a genuine commercial conflict of interest;

  • There is a safety, security, privacy or confidentiality concern;

  • A person's attendance may materially interfere with the professional purpose of the Event; or

  • There is another legitimate reason connected with the proper conduct of the Event.

  • Any such decision will be made reasonably and subject to applicable law.

NDISDA® may also limit the number of attendees from an individual organisation where reasonably necessary to maintain the intended balance, capacity or purpose of a facilitated forum, roundtable, workshop or other limited-attendance Event.

19. PERSONAL PROPERTY

Delegates are responsible for their personal belongings while attending an Event.

To the maximum extent permitted by law, NDISDA® and its Event Partners are not responsible for loss, theft or damage to personal property at an Event.

Delegates should keep valuables and personal property secure at all times.

​

20. PHOTOGRAPHY, FILMING AND RECORDING

Photography, filming and audio or video recording may occur during NDISDA® Events.

Photographs and recordings may capture a Delegate's image, likeness or voice and may be used by NDISDA® for legitimate Event-related, promotional, educational, archival and communications purposes, including websites, publications, newsletters and social media, subject to applicable privacy and other laws.

Delegates who do not wish to be photographed or recorded should contact NDISDA® before the Event and, where practicable, notify Event staff upon arrival.

​

NDISDA® will consider reasonable requests concerning the use of identifiable photographs or recordings.

Delegates must not photograph, film or record confidential case discussions, sensitive information, private conversations or material where photography or recording has been expressly prohibited.

​

Delegates must obtain appropriate permission before recording another attendee/ participant or their presentation where permission has not otherwise been granted.

​

21. WEBINARS, ONLINE AND LIVESTREAM EVENTS

Where an Event is delivered using a third-party webinar, livestreaming, conferencing or technology provider, information necessary to register for and deliver the service may be provided to that service provider.

Personal information will be handled in accordance with applicable privacy laws and the applicable NDISDA® Privacy Policy.

While reasonable measures are taken in relation to online Event delivery, NDISDA® cannot guarantee uninterrupted internet access, continuous availability of third-party platforms or that online services will be completely free from technical difficulties or unauthorised access.

Delegates are responsible for ensuring that they have suitable internet access, equipment and technology to participate in an online Event.

Nothing in this provision limits an obligation or liability that cannot lawfully be excluded.

22. INTELLECTUAL PROPERTY AND EVENT MATERIALS

Unless otherwise stated, Event programs, written materials, publications and other content produced by NDISDA® remain the intellectual property of NDISDA® or the relevant rights holder.

Materials supplied by independent speakers, presenters, Event Partners or contributors remain subject to the intellectual property rights of their respective owners.

Event materials are provided to Delegates for their personal or internal professional use unless otherwise authorised.

Delegates must not reproduce, commercially distribute, publish, sell, broadcast or substantially reproduce Event materials without permission from the relevant rights holder.

The NDISDA® name and registered trade mark must not be used in a manner that suggests endorsement, affiliation, partnership or approval without prior authorisation.

Nothing in this section restricts any use permitted by law.

23. EVENT PARTNERS, SPONSORS AND EXHIBITORS

NDISDA® may engage Event Partners, sponsors, exhibitors, supporting organisations and service providers in connection with an Event.

The participation of an Event Partner, sponsor, exhibitor or other organisation does not constitute an endorsement, recommendation or guarantee by NDISDA® of that organisation or its products or services.

Delegates are responsible for making their own enquiries and decisions before entering into any commercial, professional or service arrangement with another Event participant, Event Partner, sponsor, exhibitor or organisation.

Any transaction, referral, service agreement, commercial relationship or other arrangement entered into independently between a Delegate and another participant or organisation is between those parties.

Unless expressly agreed otherwise, NDISDA® is not a party to such an arrangement and does not accept responsibility for the acts, omissions, services, representations or performance of another participant, provider, Partner, sponsor or exhibitor.

24. LIMITATION OF LIABILITY

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other applicable legislation where doing so would be unlawful.

Subject to those statutory rights and to the maximum extent permitted by law, NDISDA®, its directors, employees, agents, advisers and Event Partners exclude liability for indirect or consequential loss arising from participation in an Event, reliance upon Event content or changes to Event arrangements.

Where liability cannot lawfully be excluded, liability will be limited only to the extent permitted by applicable law.

25. AUSTRALIAN CONSUMER LAW

Our services come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

Nothing contained in these Terms and Conditions is intended to exclude, restrict or modify any consumer guarantee, condition, warranty, right or remedy provided by the Australian Consumer Law or other applicable legislation where it would be unlawful to do so.

Where a Delegate has a statutory entitlement to a refund, compensation, damages or another remedy, that entitlement will apply notwithstanding anything contained in these Terms and Conditions.

Except where required by law, attendee-initiated cancellations remain non-refundable.

26. CHANGES TO THESE TERMS AND CONDITIONS

NDISDA® may update these Terms and Conditions from time to time.

The Terms and Conditions presented in connection with a Delegate's Event registration will apply to that registration, subject to any subsequent amendment required by law or agreed with the Delegate.

IMPORTANT BOOKING NOTICE

All attendee-initiated cancellations are non-refundable except where a refund or other remedy is required by law.

Please ensure that you are able to attend before completing your registration.

If you become unable to attend, your registration may be transferred to another eligible person in accordance with these Terms and Conditions.

Where a particular ticket, session, forum or roundtable is restricted to hospital, healthcare, government or another specified professional group, the person registered must satisfy the eligibility requirements for that ticket or session.

Delegates travelling to an Event are strongly encouraged to arrange flexible or refundable flights and accommodation and consider appropriate travel and event insurance.

Participation in an NDISDA® Event does not constitute or guarantee provider endorsement, referrals, NDIS funding, hospital or government approval, procurement opportunities, service agreements or any other commercial or professional outcome.

​

By completing your registration, you acknowledge that you have read and agree to these Event Terms and Conditions.
