NDISDA Housing and Disability Member Registration Terms and Conditions

As at 1st July 2025

Please read these terms and conditions carefully. They apply to your use of the services (“Subscribers / Registered Membership”) provided by NDISDA SDA Housing and Disability ("NDISDA"), a subsidiary of Jazcorp Australia Pty Ltd ACN 123 926 956 (“JazCorp”). By registering for and using the Membership, you agree to be bound by these terms and conditions.

0. Insurance and Modern Slavery Compliance (Mandatory)

0.1 Insurance Requirement
All Members must maintain valid and current Professional Indemnity Insurance and Public Liability Insurance appropriate to their business activities throughout the duration of their Membership.

Evidence of insurance must be provided:

  • At the time of joining;

  • Prior to being referred by NDISDA;

  • At each Membership renewal.

Failure to provide or maintain evidence of insurance will:

  • Prevent any referral through NDISDA;

  • Result in suspension or termination of Membership without refund.

0.2 Supply Chain and Ethical Compliance

  • Members must ensure that their supply chains operate ethically, comply with all applicable laws, and actively prevent any forms of modern slavery, forced labour, or exploitation.

  • Members are expected to take all reasonable steps to identify, mitigate, and address risks of modern slavery in accordance with relevant legislation.

  • Non-compliance may result in disciplinary action, including suspension or termination of Membership.

1. Agreement

This document represents an agreement between you (“the Registered Member”) and NDISDA SDA Housing and Disability (“NDISDA”).

2. Variations

NDISDA reserves the right to vary these terms and conditions at any time. Notification of variations may occur via:

i) postal service
ii) email service
iii) publication on the NDISDA website at www.ndisda.com.au
(“the Site”)

3. Enforceability

If any variation is deemed void, unenforceable, or illegal but is capable of being read down, it shall be read down accordingly. The remaining provisions shall remain in full force and effect.

4. Acceptance of Variations

Continued use of the Membership following a variation constitutes acceptance of the updated terms and conditions.

5. Waiver and Variation

No provision or right may be:
i) waived, except in writing by the granting party; or
ii) varied, except in writing signed by both NDISDA and the Member.

6. Licence and Use

The Member agrees:
i) to a non-exclusive, non-transferable licence to access and use the Membership for internal purposes only;
ii) not to re-sell, distribute, copy, or reproduce any content provided through the Membership for external use;
iii) to maintain confidentiality of all login and identification credentials;
iv) to ensure transmitted content is virus-free and indemnify NDISDA for any damages resulting from malware;
v) not to transmit illegal, obscene, or offensive material;
vi) not to breach any laws, infringe rights, or use the Membership to harass or menace others.

7. Conflict of Interest and Event Participation

To preserve the value of NDISDA initiatives:
i) Members must notify the Director in writing if they intend to present at external events that may conflict with NDISDA’s objectives;
ii) Where relevant, presentations should acknowledge affiliation with NDISDA;
iii) Written notice must be provided 30 days in advance;
iv) Members should refrain from presenting at external events within 30 days before or after an official NDISDA event;
v) endeavour to attend at least 2 NDISDA events per year, noting that NDISDA is not liable for credits, unused benefits, or non-attendance.

8. Member Conduct

Members are expected to:
i) conduct themselves respectfully;
ii) protect the privacy and views of fellow Members;
iii) avoid misconduct, which may result in membership cancellation;
iv) avoid spruiking activities, deceptive conduct, fraud, bankruptcy, or being banned from the NDIS, which will result in immediate removal.

9. Member Obligations

Members must:
i) provide current and accurate details during registration;
ii) update personal information as required;
iii) allow NDISDA to share their details as per the privacy policy;
iv) refrain from using false or unauthorised names;
v) maintain valid and current Professional Indemnity Insurance and Public Liability Insurance for the duration of their Membership;
vi) ensure all supply chains operate ethically, comply with laws, and actively prevent modern slavery, forced labour, or exploitation.

10. Privacy and Marketing

The Member agrees that:
i) their data may be used by NDISDA for direct marketing;
ii) their data may be shared with NDISDA Members and affiliates;
iii) they may opt out of marketing at any time by written notice.

11. Membership Fees

i) NDISDA reserves the right to vary fees.
ii) No refunds will be issued unless approved, in which case a cancellation fee of 80% applies.
iii) Carer and Participant memberships are free but incur a $150 annual administration fee.
iv) These memberships are non-transferable.
v) Memberships requiring payment must be cleared, or NDISDA may deny or cancel membership.

12. Vendor Contracts

NDISDA is not liable for outcomes related to vendor contracts or tenders.

13. Membership Termination

NDISDA reserves the right to terminate access without notice if:
i) fees remain unpaid;
ii) the Member misuses the service;
iii) other breaches occur, as deemed appropriate by NDISDA.

Efforts will be made to contact the Member prior to termination.

14. Post-Termination

Upon termination:
i) access to Membership ends;
ii) all Member obligations, licences, and limitations of liability remain in effect.

15. Service Provision and Modifications

NDISDA:
i) will provide services as advertised;
ii) reserves the right to modify services at its sole discretion.

16. Events Disclaimer

i) NDISDA will not be responsible for errors, omissions, or changes to programs or content delivered by third-party presenters. No refunds will be provided.
ii) NDISDA cannot control all content shared or presented by attendees or third-party presenters. Members and attendees must exercise due diligence and are solely responsible for their own safety, conduct, and interactions during events. NDISDA takes steps to ensure speakers are of good standing.
iii) NDISDA, its directors, employees, and affiliates shall not be liable for any losses, damages, liabilities, claims, or expenses arising from attendance.

17. Limitation of Liability

NDISDA, its directors, and affiliates are not liable for losses arising from event attendance or Membership usage. Members assume responsibility for their use of the Data.

18. Disclaimers

i) Membership is provided "as is" without warranties.
ii) NDISDA does not guarantee uninterrupted, error-free access.
iii) NDISDA is not responsible for the accuracy of third-party information or advertising.

19. Intellectual Property

The Member must not:
i) distribute, copy, or publish any Data for commercial use without written consent;
ii) infringe upon any third-party intellectual property rights.

20. Jurisdiction

These terms are governed by the laws of Western Australia. Disputes must be resolved in the WA courts.

21. Platinum Membership – 1300 NDISDA Benefits
21.1 Subscription Agreement

The Subscriber agrees to pay the Platinum Membership fee to access the 1300 NDISDA Contact Centre service.

21.2 Renewal

Renewal is subject to:
i) payment of fees;
ii) agreement to updated terms;
iii) approval by NDISDA.

iv) direct debit 

21.3 Call Costs

NDISDA will cover up to $600 in call costs in the first year. Charges apply as follows:
i) National landline: 7.5c/min
ii) Mobile: 9.5c/min
iii) Calls to mobile: 18.5c/min

NDISDA will notify the Subscriber when usage reaches $500.

21.4 IVR Call Centre Functionality

Subscribers receive:
i) customer redirection via IVR to their phone;
ii) fallback to next Subscriber if unavailable;
iii) email notification if voicemail is not used.

The Subscriber must ensure all contact details are accurate.

21.5 Subscriber Duties

Subscribers must:
i) pay fees promptly;
ii) respond to enquiries within 2 hours;
iii) act professionally and ethically;
iv) cooperate with NDISDA staff and systems;
v) provide accurate information for call redirection;
vi) ensure agents comply with all terms.

21.6 Warranties

The Subscriber warrants:
i) compliance with this Agreement;
ii) accurate representation of services;
iii) conduct that is ethical and lawful;
iv) qualifications to serve Customers;
v) no redistribution of NDISDA materials;
vi) respectful behaviour toward all NDISDA stakeholders.
